LITTLE FOX IN A BOX

These Terms and Conditions apply to Little Fox in a Box equipment hired from Grumpy Fox

Events (“we”, “us” or “our”). The person making the booking is referred to as “the hirer” or “you”.

By completing a booking, you confirm that you have read and accepted these Terms and Conditions.

1. Booking and hire period

Your booking is confirmed once the required £30 booking/security deposit has been received and you have received written confirmation from us.

The hire period is the period shown on your booking confirmation. Online hires may be booked for between three and seven days. Any alternative arrangements must be agreed by us in writing.

All equipment must be cleaned, correctly repacked and ready for collection at the agreed date and time.

2. Payment

A £30 booking/security deposit is required to secure the booking.

The remaining balance must be paid no later than 14 days before the event. If payment is not received by the due date, we reserve the right to cancel the booking.

The hirer is responsible for checking that all booking details, delivery information, colour choices, optional extras and personalisation details are correct.

3. Security deposit

The £30 deposit also acts as a refundable security deposit during the hire.

Following collection, the deposit will normally be returned after all equipment has been received and inspected. We will make reasonable deductions for:

  •  Missing equipment

  •  Damage beyond fair wear and tear

  •  Excessive cleaning

  •  Missing packaging or packing materials

  • Additional courier or collection costs caused by the hirer

  •  Other reasonable losses resulting from a breach of these terms

We will explain any deduction and, where appropriate, provide supporting details.

If the reasonable repair, replacement, cleaning or recovery costs exceed £30, the hirer will be responsible for the additional amount. Any additional invoice must be paid within seven days.

4. Responsibility for the equipment

All equipment remains the property of Grumpy Fox Events.

The hirer is responsible for the equipment from the point at which it is delivered into their possession, or left in a safe place they have expressly nominated, until it is successfully collected or otherwise returned to us.

The equipment must be kept clean, dry, secure and protected from theft, animals, smoke, weather and other sources of damage.

A checklist is supplied with each hire. The hirer must use this checklist when unpacking and repacking the equipment and must return every item supplied.

Equipment must not be sold, loaned, sub-hired, altered, repaired or moved to another address without our written permission.

5. Checking the equipment

The hirer should inspect the equipment as soon as reasonably possible after delivery.

Any missing, damaged or unsuitable item must be reported to us promptly and before it is used, with photographs.

Equipment that appears damaged or unsafe must not be used. Please contact us so that we can provide appropriate instructions or, where reasonably possible, arrange a suitable replacement.

The hirer will not be responsible for damage or defects that were present before delivery and reported promptly.

6. Loss, damage and non-return

The hirer is responsible for loss or damage caused during the hire period, except for fair wear and tear, existing defects or damage caused by our negligence.

Items that are lost, not returned or damaged beyond economical repair will be charged at their reasonable replacement cost. Repairable damage may be charged at the reasonable cost of repair.

This may include:

  •  Missing items

  •  Punctures, tears or permanent staining

  •  Water or weather damage

  •  Damage caused by shoes, food, drink, face paint, glitter, pens or sharp objects

  •  Equipment returned in an unusable condition

  •  Loss or damage caused by incorrect packing

  •  Non-return of part or all of the equipment

Failure to return the equipment by the agreed collection date will be treated as a breach of these Terms and Conditions.

Where equipment is deliberately or dishonestly retained, sold, disposed of or not returned following reasonable requests from Grumpy Fox Events, this will be treated by us as suspected theft or another suspected criminal offence. The matter will be reported to the police, and we will take further action to recover the equipment and any associated losses or replacement costs.

7. Cleaning and repacking

All equipment is thoroughly cleaned and sanitised by us between hires.

The hirer must wipe away dirt, sticky marks and spillages before repacking. Equipment must be completely dry before being placed into its packaging.

Balls must be returned to the bag supplied and all pieces must be packed in accordance with the supplied checklist and repacking instructions.

The supplied packaging, boxes and reusable packing materials must be kept safe and returned. A reasonable charge may be made for replacement packaging or excessive cleaning caused by misuse.

8. Safe use and supervision

The equipment is designed strictly for children under four years old unless we have confirmed otherwise in writing.

A responsible adult aged 18 or over must supervise the equipment and children using it at all times.

The following rules apply:

  •  Socks must be worn; no shoes

  •  No food, drinks or chewing gum

  •  No face paint, glitter, pens, crayons or messy play

  •  No sharp objects, jewellery or items that could puncture or mark the equipment

  •  No pets on or near the equipment

  •  Equipment must remain on the supplied mats

  •  Equipment must not be used beyond its intended purpose

  •  The number, age and ability of children using the equipment must be safely managed by the supervising adult

The hirer must follow all safety, setup and repacking instructions supplied with the equipment.

9. Setup area

The hirer must provide a clean, flat, level and suitably sized setup area, free from hazards, sharp objects, steps, open fires and other obstructions.

10. Outdoor use

Outdoor use is permitted only during suitable summer weather and at our discretion.

Equipment must:

  •  Be placed on the supplied ground sheet on clean, dry and level ground

  •  Not be used when rain, strong winds or unsuitable weather are forecast

  •  Not be placed on muddy, abrasive or waterlogged ground

  •  Be brought indoors immediately after use

  •  Never be left outside overnight

The hirer must stop outdoor use and move the equipment to a safe, dry location if weather conditions change.

The hirer may be responsible for reasonable cleaning, repair or replacement costs where damage results from ignoring these requirements.

11. Delivery and collection

Delivery and collection will be carried out by a trusted UK courier or a member of the Grumpy Fox Events team.

Courier time windows are estimates supplied by the courier and may occasionally change.

We will take reasonable steps to deliver the equipment in time for the booked event and will notify you of any significant issue we become aware of.

The hirer must provide a complete and accurate delivery address, postcode, mobile number and any access information required.

Where the hirer nominates a safe place, it must be secure, sheltered, dry and accessible. The hirer accepts responsibility for the equipment once it has been delivered to that nominated safe place.

If nobody is available and no suitable safe place has been authorised, the courier may be unable to complete delivery or collection.

Reasonable additional charges may apply where a delivery or collection fails because incorrect information was supplied, access was unavailable, the equipment was not ready, or the hirer missed an agreed collection.

12. Courier delays and events beyond reasonable control

In the unlikely event that delivery or collection is affected by severe weather, road closures, courier disruption or another event beyond either party’s reasonable control, we will communicate with you and take reasonable steps to minimise the effect of the disruption.

If we are unable to provide the hire in time for the event and no reasonable alternative or new date is agreed, we will refund payments for the affected hire. This does not affect your statutory rights.

13. Personalisation and optional extras

The hirer must provide accurate names, ages, wording, themes, colours and other personalisation instructions by the deadline we provide.

Please check spelling and punctuation carefully. We will not be responsible for errors contained in information supplied or approved by the hirer.

Where no themed styling package has been selected, suitable hopper animals and coordinating items will be selected at random according to availability.

Requests for particular hopper animals, shades or styling details are not guaranteed unless confirmed by us in writing.

Personalised items may not be reusable. Costs already incurred in preparing bespoke items will therefore be taken into account if a booking is changed or cancelled.

14. Cancellation by the hirer

If you cancel:

  •  The £30 booking deposit is non-refundable

  •  More than 14 days before the event: any additional balance paid will be refunded

  •  Between seven and 14 days before the event: no refund will be given

  •  Within seven days of the event: no refund will be given

Any amount retained will not exceed the reasonable costs and net losses arising directly from the cancellation, taking into account costs already incurred and our ability to rehire the equipment. We will take reasonable steps to reduce our loss where possible.

We will try to accommodate a date change, subject to availability. A date change is not confirmed until agreed by us in writing.

Nothing in this clause limits any statutory cancellation rights that apply to your booking.

15. Cancellation by us

We may cancel or refuse a hire where:

  •  Payment remains overdue after a reasonable opportunity to pay

  •  The delivery or setup information provided is materially inaccurate

  •  We reasonably believe the equipment would be used unsafely

  •  Suitable equipment becomes unavailable because of damage, loss or another event beyond our reasonable control

  •  Severe weather makes an outdoor hire unsafe

If we cancel for a reason that is not caused by the hirer’s breach, we will offer a suitable alternative, a change of date or a refund of payments made for the affected hire.

16. Liability

Grumpy Fox Events will not be responsible for injury, loss or damage caused by:

  •  Misuse of the equipment

  •  Failure to supervise children

  •  Failure to follow the supplied safety instructions

  •  Use of the equipment by children outside the stated age limit

  •  Any breach of these Terms and Conditions by the hirer

Nothing in these Terms and Conditions affects the hirer’s statutory rights or excludes any responsibility that Grumpy Fox Events cannot legally exclude, including responsibility for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

We will only be responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or negligence.

17. Privacy

We will use personal information supplied during the booking process to administer the booking, take payment, arrange delivery and collection, communicate with the hirer and meet our legal obligations.

Personal information will be handled in accordance with our Privacy Policy and applicable data-protection law.

18. Complaints and contact

Please contact us promptly if there is a problem with your booking or equipment so that we have a reasonable opportunity to resolve it.

19. General provisions

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

No change to the booking or these terms is effective unless agreed by both parties.

These terms are governed by the laws of England and Wales. Customers living elsewhere in the United Kingdom retain any mandatory rights available to them under the law that applies where they live.

These terms do not affect your statutory rights.

These terms are intended to help every family receive the same safe, clean and beautifully presented Little Fox in a Box experience.
